    A Challenge to the Superintendent in the Texas Cheerleader Assault Case

    NOTE: There is a campaign calling for everyone to send one penny to the superintendent of schools.

    My report on the Silsbee, Texas cheerleader assaulted by a high school sports hero and then extensively revictimized by the Hardin County community has occasioned a huge outpouring of concern over a court decision requiring the victim to pay the school’s attorneys' fees of $45,000. The assessment seems particularly outrageous in view of a court having fined the victim’s assailant only $2,500. I have issued a challenge to Silsbee Schools Superintendent Richard Bain, the details of which are below. We will be publishing a later update as to whether Superintendent Bain and the school's attorneys have agreed to waive the $45,000 fee, or if they would prefer to have individuals from all over send in one cent each until the $45,000 fee is paid in full.

    Superintendent Bain:

    I have reported here on the tragedy suffered by "H.S." at Silsbee High School:

    I believe everything in my report is factual. A reporter for the Silsbee Bee had told me . . prior to the publication of my article . . that he had seen the entire case file related to this matter and that if others were to see it, they would believe there were no grounds for criticizing Silsbee in any way. I have now asked the Silsbee Bee to provide documentation showing that anything reported in my article is not factual. If anything in it is not factual, I shall be publishing corrections.

    Apart from that question, though, there has been a huge outpouring of concern for H.S. as regards the $45,000 fees she has been ordered to pay to the Silsbee Independent School District's attorneys after she lost her free speech case against the school.

    The reality is, you did attempt to compel the victim to cheer individually for a student, a Silsbee High School sports hero, who eventually pleaded guilty to assaulting her. Her free speech case grew out of that incident.

    I, personally feel, as do many other people, that you and your attorneys should waive the fee, and let the court know that you will not be requiring the assault victim to pay it.

    If you will not do that, then I, along with assistants, will be organizing an effort to pay the fee by having the necessary number of people send one penny each.

    So, here is what I wish to know from you now. Will you and the Silsbee Independent School District be arranging things with the court such that the assault victim will not have to pay the $45,000 attorneys' fee? If not, then please provide the correct address to which people should send their one penny donations towards the $45,000.
